KEBBI HIGH COURT SENTENCE TRIO TO LIFE IMPRISONMENT OVER RAPING A DEAF HOUSEWIFE
The sitting judge of Kebbi State High Court, Justice Shamsudeen Jafar has sentenced the trio men to life imprisonment for raping an 18-year-old deaf, married woman.
The convicts identified as Amiru Sani, Aliyu Umar, and Bashar Dan-Inno of Wararin Zaromawa village, were on 23rd July 2024 arraigned over two counts of criminal conspiracy and rape, offences punishable under Sections 259 and 60 of the Kebbi State Penal Code Law, 2021.
Available information indicates that the defendants perpetrated the act at the Wararin Zaromawa village, Gwandu LGA. They broke into her house forcefully and had carnal knowledge of her. They also choked her with a thick piece of cloth and tied her hands with a rope before having carnal knowledge of her one by one.
The judge firmly established that all the defendants conspired in committing the act. The convicts conspired and raped the victim, an 18-year-old deaf woman, at her husband’s residence. The prosecution successfully proved all elements of criminal conspiracy to commit rape beyond reasonable doubt. Therefore, the court must act on the evidence presented.
The prosecution previously called three witnesses and submitted six exhibits, including statements in both English and Hausa from the three witnesses, to support its case.
The prosecution counsel requested the court to convict the defendants as charged, given the law’s mandatory sentence.
Delivering his judgment, Justice Shamsudeen Jafar declared that the court found the first, second, and third defendants guilty as charged, sentencing them to life imprisonment under Sections 259 and 60 of the Kebbi State Penal Code Law, 2021.
