COURT STOPS NERC, KEDCO FROM HIKING ELECTRICITY TARIFFS

The Federal High Court in Kano has granted an interim order halting the National Electricity Regulatory Commission (NERC) and the Kano Electricity Distribution Company (KEDCO) from enforcing a recent hike in electricity tariffs for Band A consumers within the DisCo’s jurisdiction.


NERC recently mandated electricity distribution companies to increase tariffs for Band A consumers in order to guarantee a reliable power supply for those who can afford it. However, NERC faced criticism from many Nigerians who pointed out that despite being moved to Band A, they still experience unstable electricity supply.


However, on 2nd May 2024, Justice A.M. Liman of the Federal High Court in Kano granted an interim order following an ex-parte motion presented by A.B. Mahmoud, SAN. He represented Super Sack Company Limited, BBY Sacks Limited, Mama Sannu Industries Limited, Dala Foods Nigeria Limited, Tofa Textile Limited, and the Manufacturers Association of Nigeria Limited (MAN), all as Applicants.


The ruling barred NERC and KEDCO from enforcing the tariff hike set to begin this month until the motion on notice is heard and determined. Furthermore, it forbade the defendants from intimidating or threatening to cut off the Applicants' power supply for refusing to accept the new tariff.
