JUSTICE OF LAGOS HIGH COURT ORDERS ARREST OF IMMIGRATION OFFICER FOR DISOBEYING WRIT

The Chief Justice of Lagos High Court sitting in Tafawa Balewa Square (TBS), Sherifat Sonaike, on 28th February 2023 ordered the arrest of one Umar Mohammed, an immigration officer, for defying a writ earlier issued to him over an alleged assault.


The order followed an application presented by Alaba Kuku, the state Counsel prosecuting on behalf of the Director of Public Prosecution (DPP), following the refusal of Mohammed to appear before the court of law on 19th January 2023, to defend two charges filed against him by the state government.


However, the Director of Public Prosecution (DPP), Dr. Babajide Martins, in an application, required the court to issue criminal summons against the defendant, which would compel him to appear for his trial.

Meanwhile, the state government had in a charge marked LD/120518c/2022 filed against Mohammed, for allegedly and unlawfully assaulting one Oluwafemi Adeyemi Badiru, on 30th July 2019 by slapping him in his office at Nigerian Immigration Service Ikeja, Lagos, and causing him to suffer epistaxis (nosebleed).


His offense is contrary to Section 173, 174 (e) of the Criminal Law Ch. C17, vol. 3 Laws of Lagos State 2015.


Therefore, Justice Sonaike ordered the Comptroller General of Immigration to produce the defendant before the court in Lagos on April 4, 2023, and provide an answer to the said charge. Hence, further dealt with according to law and adjourned to April 4, for mention.
