OIL SPILLAGE: SUPREME COURT STRIKES OUT SHELL'S APPLICATION TO REVIEW OGONI 17BN JUDGMENT

The Supreme Court has dismissed an application by the Shell Petroleum Development Company to review a 2019 judgement ordering the oil giant to pay 17bn to some Ogoni communities in Rivers State who were affected by an oil spill from the company in 1970. 


The apex court on January 11, 2019 upheld the judgement of the Court of Appeal which slammed a 17bn fine against Shell for oil spillage in Ejama-Ebubu in Tai Eleme Local Government Area of Rivers State in a case that has spanned three decades.

However, the oil giant forwarded an application to the Supreme Court to review and set aside the judgement. 


The legal counsel of the respondent led by Lucius Nwosu described the oil giant's request as scandalous and a deliberate abuse of court processes. 


On Friday, September 27, a five-man panel led by Justice Olabode Rhodes-Vivour unanimously dismissed Shell's application for a review, upholding the preliminary objection filed by the communities' legal team.
