POLICE ARRAIGN COMMERCIAL MOTORCYCLIST FOR ASSAULTING A POLICE OFFICER, BREACH OF PUBLIC PEACE IN OSUN STATE

A 43-year-old motorcyclist identified as Olaoye Moses, was arraigned before two Magistrate’s Courts in Osogbo, for allegedly assaulting a police officer on duty, and also commercializing his motorcycle without a functional brake.


The defendant was arraigned by the Osun State police on 23rd May 2023 on two separate charges for allegedly assaulting one Sergeant Bankole Abiodun while lawful performing his duty at Ota-Efun Market Square in Osogbo, the state capital.


Then, the police prosecutor, Inspector Akintunde Jacob, revealed to the court that the defendant almost infringed the public peace following his assault by mobilizing the crowd against the officer at the market.


The prosecutor also added in the court that the convict allegedly refused to slow down for police officers, who were crossing the road through the pedestrian route.


Some of the counts read partly: “That you Olaoye Moses, on May 23, 2023, at about 1000hrs at Ota-Efun Market Square in Osogbo, did assault one Sergeant Bankole Abiodun while performing his lawful duty.”

   

Therefore, the defendant’s offenses were contrary and punishable to sections 516 and 249(d) of the Criminal Code Cap 34 Vol II Laws of Osun State of Nigeria, 2002.

  

Nonetheless, the defendant gave his plea of not guilty to the charges before the two different Magistrates’ courts. Thus, the defendant’s counsel, Kehinde Adepoju, encouraged the court to grant Moses bail in liberal terms.


Magistrate A.O. Daramola, under where the defendant was arraigned for dangerously riding a motorcycle on a public highway without a functional break, granted him bail in the sum of N50,000, with one of his blood relations as surety in lieu, and adjourned to June 26, 2023, for mention.

   

Meanwhile, Magistrate A. A. Adeyeba of another court where Moses was arraigned for alleged assault on a police sergeant ordered that the accused person be remanded in Ile-Ife Correctional Centre
