POLICE ARRAIGN TWO OVER ALLEGED FRAUD

The Federal High Court sitting in Lagos received the arraignment of two men Mshelia Silas and Sabo Jimeta, by The Police Special Fraud Unit on 18th April 2023 over the unlawful sale of property and alleged diversion of N800m.


The information available indicates that the defendants, with intent to defraud, conspired and fraudulently sold off a property belonging to one Abubakar Zango located at 3, Bunu Sheriff Crescent, Katampe Extension, Abuja, for N800m.


The defendants facing a three-count of conspiracy, fraud, and unlawful diversion of the fund were arraigned alongside a company, Jitau Investment Limited.

The prosecutor, CSP Emmanuel Jackson, who led Justin Enang, described to the court that the defendants, alongside Albert Atiwurcha; Nanda Ezekiel, and J &J Holding Villa Limited now at large, conspired to commit the offense which he noted that upon selling off the property, the defendants diverted the proceeds into two bank accounts, Union Bank Plc account number 0041529275, own by Jitau Investment Limited, and Zenith Bank Plc’s account number 1016265443, belonging to J and J Holding Villa Limited which is different from what Zango, the owner of the property has nominated.


Hence, the prosecutor declared the offenses committed contravened sections 1(3) and 1(i)(a) and of the Advance Fee Fraud and Other Fraud Related Offences Act No. 14 of 2006 and Section 15(2)(b) of the Money Laundering (Prohibition) Act, 2011 as Amended in 2012.


Consequently, the defendants pleaded not guilty to the charge against them, and therefore, their lawyers, Kyari Gadzama(SAN); Kole Bello, and J. W. Dong, informed the court that their clients’ bail applications had been filed and served on the prosecution. Also, they urged the court to admit their clients to bail in the most liberal terms, and that the court should also grant him bail on self-recognizance.


The prosecutor, however, disagreed with the bail applications.


Meanwhile, Justice Oweibo admitted the defendants' bail application and to bail in the sum of N500m, each with one surety in like sum. While the justice adjourned the matter till 21 June 2023 for trial, he ordered that the defendants be remanded in the custody of the SFU till they perfect their bail conditions.
